With six judges dissenting, the 9th U.S. Circuit Court Of Appeals on Tuesday let stand a controversial ruling that found the Second Amendment doesn't give individuals a right to bear arms. Among the six who argued that the case (Silveira v. Lockyer, 312 F.3d 1052) should be reheard by an 11-judge en banc panel was the staunchly liberal Judge Harry Pregerson. But the yeoman's work in dissent was done by Judge Andrew Kleinfeld, who defended an individual's right to bear arms using the same means Judge Stephen Reinhardt employed in December to shoot it down: by weaving together scholarship, grammar and historical analysis... The rhetorical star of the dissenters was Judge Alex Kozinski, who chided Reinhardt's panel for endorsing individual rights in a selective manner. Kozinski, who as a child fled Romania when it was under the grip of dictator Nikolai Ceausescu, wrote that American slaves and Holocaust victims could have fought back had they been allowed to own guns. "The Second Amendment is a doomsday provision, one designed for those exceptionally rare circumstances where all other rights have failed - where the government refuses to stand for re-election and silences those who protest; where courts have lost the courage to oppose, or can find no one to enforce their decrees," Kozinski wrote. The only way to learn the non-linear nature of water is through empirical observation, through actually living with water and ice rather than simply theorizing about water and ice. Because once you SEE that very cold water becomes lighter rather than heavier, then you KNOW that there must be something WRONG with your theory of thermodynamics. Same thing with economics. Excellent David Schmaltz posting about thinking of a Project Team as a Project Community. I think of the role of project community membership as bringing with it a set responsibilities, similar to the responsibilities that Citizenship carries... This transforms the project assignment into something other than simply an individual fulfilling a role "for" the project, which can place the individual's needs, interests, and full capabilities into the background behind their defined project role, at some level sacrificing themselves for the project, into one where an individual's role becomes a medium for them to more fully express themselves... In a classic project role, someone tells you what to do and you agree to do it. If you aren't directed to do it, you can't be held accountable for it not getting done. The community member's role isn't structured like that... With the project community member role come a number of "enlightened Self Interest"-level choices, (including) the choice (Agency) of using your assigned role as a medium for pursuing your own purpose, because this creates the foundation for a personally and collectively Juicy experience... That these ethics are better known than they are commonly exercised was one of the reasons I wrote the book in the first place. Our Mastering Project Work workshop focuses upon these choices, and helps individuals bring this often Tacit Knowledge into more mindful play. So, as a Project Manager, I will assign roles and responsibilities, and as a project Community Builder, I will engage in conversations focused upon helping others find their project within their project assignment.
